Civil Litigation is where one citizen (the plaintiff) seeks a remedy through the Courts from another citizen (the defendant) as a result of some wrong committed by the defendant. The most common form of remedy awarded by the Courts is monetary damages.

Civil litigation can be instituted in connection with the following:-

  • Negligence
  • Breach of Contract
  • Breach of Statutory Duty
  • Debt Recovery
  • Trespass
  • Copyright, Patent and Intellectual Property Rights
  • Criminal Damage, i.e. malicious damage to property
  • Criminal Injury Appeals, i.e. appeals against awards for injuries sustained as a result of an assault.

Civil Legal Aid may be available in certain circumstances although it has become increasingly difficult to obtain.
